Rhode Island has some of the most robust lead safety laws in the country. Since the majority of RI housing was built before 1978, the state operates under a "Lead-Safe" standard, which focus on mitigating hazards (like dust and peeling paint) rather than requiring the total removal of all lead.

As of 2024–2025, the laws have expanded significantly, including a mandatory statewide rental registry and the removal of many previous exemptions.

 

     For Homeowners (Owner-Occupants)

If you own and live in a single-family home, you are generally not required by law to have a lead certificate. However, there are two major things you need to know:

  • Renovation Rules (RRP): If you hire a contractor to work on your pre-1978 home, they must be Lead-Safe Certified. If you do the work yourself, you are strongly encouraged to use "lead-safe work practices" to avoid contaminating your home with toxic dust.

  • Selling Your Home: You must provide a Lead Disclosure to buyers. Buyers have a legal right to a 10-day period to conduct a lead inspection at their own expense before being bound by a sales contract.

  • Tax Credits: RI offers a personal income tax credit of up to $5,000 per unit for lead abatement (permanent removal) and up to $1,500 for lead mitigation

    For Landlords (Property Owners)

  • Rhode Island law now requires nearly all landlords of pre-1978 properties to be proactive. The "owner-occupied" exemption for 2- and 3-unit dwellings was removed as of January 1, 2024.

     Your Requirements

  • Renewal: Certificates must be renewed every two years. If the same tenant stays longer than two years, you can extend the certificate by taking a 3-hour lead awareness class and filing an Affidavit of Visual Inspection.

  • Statewide Rental Registry: All landlords must register their units on the RI Rental Registry. You cannot legally rent a unit or, in many cases, file for an eviction without a valid lead certificate uploaded to this registry.

  • Tenant Disclosure: You must give every new tenant the EPA’s Protect Your Family from Lead in Your Home pamphlet and a copy of the property's lead certificate.

Warning: Failure to comply can result in "Rent Withholding." Under new laws, tenants may be authorized to pay rent into an escrow account rather than to you if the property lacks a valid lead certificate.

     For Renters

As a renter in Rhode Island, you have the right to live in a "Lead-Safe" environment.

  • The Right to Know: Your landlord must show you a valid Lead Certificate before you sign a lease for a home built before 1978.

  • Checking Compliance: You can search for your address on the RIDOH Lead-Safe Property Search to see if your unit has a current certificate.

  • Identifying Hazards: If you see peeling or flaking paint, or "paint dust" near windowsills, notify your landlord in writing. They have 30 days to address the hazard using lead-safe methods.

  • Free Testing: In Rhode Island, lead screening for children under age 6 is often free or covered by insurance. If a child is found to have elevated blood lead levels, the state can mandate a comprehensive environmental inspection of your home.
